In a move clearly intended by the Obama Administration to suppress the acquisition, ownership and use of AR-15s and other .223 caliber general purpose rifles, the Bureau of Alcohol, Tobacco, Firearms and Explosives unexpectedly announced today that it intends to ban commonplace M855 ball ammunition as “armor piercing ammunition.” The decision continues Obama’s use of his executive authority to impose gun control restrictions and bypass Congress.

It isn’t even the third week of February, and the BATFE has already taken three major executive actions on gun control. First, it was a major change to what activities constitute regulated “manufacturing” of firearms. Next, BATFE reversed a less than year old position on firing a shouldered “pistol.” Now, BATFE has released a“Framework for Determining Whether Certain Projectiles are ‘Primarily Intended for Sporting Purposes’ Within the Meaning of 18 U.S.C. 921(a)(17)(c)”, which would eliminate M855’s exemption to the armor piercing ammunition prohibition and make future exemptions nearly impossible.      

By way of background, federal law imposed in 1986 prohibits the manufacture, importation, and sale by licensed manufacturers or importers, but not possession, of “a projectile or projectile core which may be used in a handgun and which is constructed entirely . . . from one or a combination of tungsten alloys, steel, iron, brass, bronze, beryllium copper, or depleted uranium.” Because there are handguns capable of firing M855, it “may be used in a handgun.” It does not, however, have a core made of the metals listed in the law; rather, it has a traditional lead core with a steel tip, and therefore should never have been considered “armor piercing.” Nonetheless, BATFE previously declared M855 to be “armor piercing ammunition,” but granted it an exemption as a projectile “primarily intended to be used for sporting purposes.”

  1. I’m sure that the rule by fiat will continue and lawlessness will continue so long as Obama is in office. He can no longer use Congress. Essentially it’s an F-you to the people who didn’t vote for him and would never vote for him. Two more long years.

    Here we go again….but I think the Professor is on to something. Sure You can send a typewritten letter to the ATF, and they will file it in the circular shredder anyway. They will do the bidding of the Obama regime, they have always been a lawless agency and stepping on a few dozen more laws ain’t gonna matter to them. I apologize for sounding negative, but they have no accountability.

    I’m thinking Joe Biden wouldn’t be such a bad choice for the next two years.

    • If Biden becomes president he has a pre-designated “butt buddy” to come in as Chief of Staff. That may be helpful.

      • Butt buddy? Is that the same as an asshole buddy? Or maybe that is Biden’s version of Location, location, location.

  8. Face it, they are scared because so many of us have this type of ammo and their PPE can’t stop it. Better buy as much as you can before it’s all gone and price gouging begins. Reloads too.

  9. Do the same regulations apply to the Feds as well ? You know – to serve as an example to the serfs – er – citizens ?

  10. Senior- Good point! And you and I both know PPE would not stop a STANDARD hunting round… 855 is not and never will be armor piercing…

    I don’t think this ammo ban is going anywhere, but we are in the final quarter of O’Bummer’s reign and the BATFEIEIO is known to do some strange shit. Write your letters and I’ll write mine.
