Above the law???

I think not…

Like neon lights in the fog, five words we’ve seen and heard everywhere, along with the self-righteous posts:

“Nobody is above the law!”

We heard those five words more than we heard “Good morning” or “Have a nice day.” 

They echoed from tote bags, blared across chyrons, and rang out in chants from crowds cheering FBI raids on pro-life activists and conservative school board members—repeated so often that we began to believe they meant what they said.

However, when progressive Milwaukee Judge, County Circuit Judge Hannah Dugan helped a man here illegally slip out the side door with hopes of dodging ICE like a rabbit outrunning a cheetah, those five very sacred words vanished.

Suddenly, without a preamble, those five words were replaced by:

“She was acting in her official capacity.”

Interestingly, a federal magistrate has recommended the case go forward, HERE.  Magistrate Joseph said, “A judge’s actions, even when done in her official capacity, does not bar criminal prosecution if the actions were done in violation of the criminal law.”

Funny how the shoe is on the ‘other’ foot and suddenly those words aren’t applicable…

Personally, I’m glad to see it, as had it been one of us peons, we’d already be in jail for breaking the law. I did notice this pretty much disappeared from the MSM in a big hurry, and really hasn’t had any ‘in depth’ coverage.

So, now we wait… and hope…

  1. Yeah, “Nobody is above the law” when Trump is prosecuted for a crime the federal attorney dropped. Now that Comey and Brennan have been referred for criminal prosecution for “Crossfire Hurricane” it’s “Trump is weaponizing the FBI for political purposes.”

  2. ‘Privilege’ = Private Law. Law for a small group, or just the one.
    Note: The French, on one of their better days, found a way to deal with this.

    Its about time some of the “Privileged Class” are held accountable for their decisions. I hope this spreads. I have seen this too often as you have where there are 2 sets of rules, one for us *Dirt People* and one for the *CLoud people* and they get away with crap that would have us making gravel at Leavenworth confinement barracks. Justice is supposed to be blind, but it sure ain’t. Matter of fact those in public office should be held to a higher standard because they ARE in public office representing *US*.

The basic and fundamental problem that the small c communists had within the Democratic Party is that they planned on pounding legal theory, in a situation where the public may be deeply divided and unpersuadable about what that most essential legal theory is, and perhaps that both sides of that dispute would not find the specific appeal by the Democrats very persuasive.

    It would have worked for the case that the reality of human behavior in America really was as congress had paid academics to describe it as being.

    But, in that sort of universe, MAGA would not have taken off in the first place. Because the ‘uneducated’ would not have had minds and thoughts of their own, and would not have been quietly evaluating whether the advanced degree holders were really acting as honest proxies. (There are absolutely more intellectual and more academic thinkers within MAGA, some of them claiming credit for guiding the thing, but none of them are truly responsible for the first motions.)

    Anyway, academics estimated that they had been thwarted by ‘bad’ thought leaders, through leadership magic and theory magic. Brutal academic trained lunatics in politics decided that the answer was a show of force to shut down the ‘small number of defecting thought leaders’, and thus neutralize the masses again. They had their shows of force.

    Which failed, partly because they did not account for alien-to-them perceptions about what is truly going on. Partly because they did not have a real balance of force aligned for them, ready to bust heads to create fear. (American shooters seem to fear or be concerned about other shooters, and spend a lot of time and effort on not behaving criminally in the eyes of the other shooters. They are extremely reluctant to do cartel tactics, especially on behalf of someone from outside of their various communities.)

I’m gonna go mow my grass , then attach my custom designed milk crate fishing gear / rod holder to the 4whlr , and go to my buddy’s hidden secret pond , fish till the heat near kills me , come home and drink some Colorado panther piss , take a shower , then sit around “commando” in my gym shorts , and tell the world (under my breath) to kiss my big fat white redneck ass . F it !!!

  8. Funny thing is, I actually agree—no one should be above the law. That’s why I support the prosecution of anyone who breaks it, including judges, presidents, and everyday citizens.

    But we shouldn’t pretend this is a left-vs-right issue. Judge Dugan is being prosecuted under the very same legal standard the right claims to want—so the law is working.

    What I find harder to swallow is how many people suddenly stop believing in “law and order” when it comes to someone like Donald Trump. If helping someone avoid ICE is a criminal act, what about refusing to return stolen classified documents or inciting a mob to stop an election?

    If “no one is above the law” really means what we say it does, let’s apply it across the board, not just when it feels good.

What I find sad is that when decisions on cases such as this, where the violation of law couldn’t be more obvious and clear, we sit on the edge of our seats waiting to see which way those legal scholars in robes will go. We have collectively lost all confidence in the entire system — not that it hasn’t been a long time coming.

  11. All- Interesting points of view… RJ, really? Both of those have been debunked time and time again. What about Joe or Hillary? Both of them are also guilty of ‘having’ classified in unsecure locations, are they not?

    BobF- Sadly, I can’t disagree. Especially after the last 8-1 SCOTUS decision and Jackson’s rebuttal…

    • OldNFO, could you clarify what you believe has been debunked? If we’re talking about the argument that Trump defied a subpoena—he did, and that’s part of why he was charged. If you’re referring to green card holders being criminalized under shifting rules, that too is well-documented in legal challenges to Trump-era TPS, DACA, and “public charge” rule changes. I’m happy to look at actual sources if there’s a specific point you think was debunked.
