Undated documents show that federal agents are trained to “recreate” the investigative trail to effectively cover up where the information originated, a practice that some experts say violates a defendant’s Constitutional right to a fair trial. If defendants don’t know how an investigation began, they cannot know to ask to review potential sources of exculpatory evidence – information that could reveal entrapment, mistakes or biased witnesses.
“I have never heard of anything like this at all,” said Nancy Gertner, a Harvard Law School professor who served as a federal judge from 1994 to 2011. Gertner and other legal experts said the program sounds more troubling than recent disclosures that the National Security Agency has been collecting domestic phone records. The NSA effort is geared toward stopping terrorists; the DEA program targets common criminals, primarily drug dealers.

As the article points out, there is a HUGE difference between “parallel discovery” to document Probable Cause, and this practice of inventing the investigation.
Should result in the criminal cases being tossed. It won’t, but it should.
The “rabit hole” becomes deeper and darker day by day.
No real suprise here though. A government that is no longer accountable to the people, a government that nearly half of the people are dependent upon, a government that is “lead” by the most lawless president in my lifetime . . . .
My soul absolutely shudders at the thought of where we are headed.
I’m sure they’ll investigate themselves and let us know if they’re doing anything wrong.

So, maybe there’s smoke, maybe there isn’t.
Think about this from a different angle. An Agency, in the course of monitoring something that they are allowed to legally do, comes across something that points to a US citizen performing an illegal act. That information cannot be pursued legally by said Agency (Agency1). So they hand it off to another Agency (Agency2) that can legally pursue said illegal act. But to protect Agency1’s classified sources, Agency2 starts a whole new investigation of that individual, not using any information from Agency1 other than the tip. Agency2 develops a whole new chain of evidence based on detective work that was not performed by Agency1.
Now, let’s call your local PD as Agency1, having overheard a major illegal gun deal, hands that info to ATFE as Agency2. ATFE wants to protect their source, so starts a new investigation, not using the tip from the local PD.
