Gun Owners Foundation and the Virginia Citizens Defense League asked a Virginia court Thursday to hold the state in contempt after it began enforcing a universal background check previously blocked by a permanent injunction.
Democratic Virginia Gov. Abigail Spanberger signed HB 1525 into law on April 22 after the General Assembly concurred with her amendments directing the Virginia State Police (VSP) to enforce the law blocked by the injunction and adding an emergency provision. Circuit Court for the City of Lynchburg issued a permanent injunction in October 2025 after declaring the state’s universal background check unconstitutional, leading to Thursday’s contempt motion brought by the pro-Second Amendment organizations.

So, they modified the bill, called it an ’emergency’, didn’t get the required 80% approval of the Virginia legislature, but ordered it anyway…

This on top of the blatantly unconstitutional “assault firearms” and “high capacity magazine” bans, which have resulted in several pro-2A groups filing suit against the Commonwealth as well as the USDOJ threatening to also do so. Oh yeah, and several county sheriffs and Commonwealth Attorneys (prosecutors) stating in public they will not enforce those bans. Which of course resulted in the VA Gov and AG whining about selective enforcement and not having discretion to choose what laws they enforce, when VA law actually does give local prosecutors a lot of discretion as to what laws they enforce at the misdemeanor level, which is where those bans lie at this point.

Theoretically, any law that is obviously in violation of court orders, or the Constitution, should be ignored. That’s where I have a problem. If the governor signed a law that violate what a court decided, and is obviously unconstitutional, they are a seditionist, and should be charged for the crime. Arrest is necessary, and the lieutenant governor should take over. More litigation is a waste of time, and resources. The courts have already decided, and the criminals need to be punished.

I think that enough American voters will see who they are, and refuse them, but looking at examples like Wisconsin, with 1.5 million more “voters” than they have people over 18 in the state, our votes may not be enough.
Pass the SAVE Act. Now.

In summary, ‘they’ may have celebrated winning the election, but their plan to capitalize on the win is perhaps delusional will-to-power nonsense.
Dennis- Sadly, that one doesn’t have any ‘teeth’, it needs to be put on the ballot/recall election, which means only registered VA voters signatures are required.

I don’t recall hearing about any Virginia badgemonkeys ignoring the order to violate he injunction and make arrests….mostly because they are “just following orders”. I remember when 80 years ago “just following orders” could get you a prison sentence…or even a date with a rope.
Virginia gets away with thumbing its nose at the Constitution (and SCOTUS decisions), but so does NY, California, Massachussetts, Connecticut, Oregon, Washington – do I have to go on?
Some how these states have to be reined in – by who? how?
